Data Asset Foundations

A dedicated Isle of Man structure for holding, governing and supporting the commercial use of defined data assets.

Businesses can hold valuable data but face difficulties demonstrating their rights, agreeing permitted uses and giving partners confidence in its governance. A Data Asset Foundation (DAF) brings a dedicated legal structure together with registration and independent assurance to help address these issues.

How does it work?

The framework builds on the Isle of Man Foundations Act 2011, as amended in 2026. A DAF is a separate legal entity with a Council responsible for its management, a registered agent and a Data Enforcer with statutory oversight responsibilities.

1  Establish and define. Form the foundation, identify the data asset and establish the rights and permissions to be dedicated to it.

2 Govern and assess. Put appropriate governance arrangements in place and obtain independent accreditation through an Accredited Assurance Provider.

3 Register and use. The process moved from provisional to full registration. Full registration creates a statutory personal property right vested in the foundation.Commercial use remains subject to the dedicated rights, applicable law and valid accreditation.

What could it offer?

    •     A clearer legal structure for holding defined data rights, with responsibilities for stewardship and oversight.

    •     A basis for licensing, collaboration and other commercial arrangements, supported by documented rights and independent assurance.

    •     A dedicated entity through which data assets can be managed separately from the wider business.

Potential users include businesses in financial services, gaming, technology and research. Suitability depends on the rights available, the intended use and whether the commercial opportunity justifies the costs.

    Important points

The rights held by the foundation depend on what is dedicated to it. Registration does not override data protection obligations or create a lawful basis for processing personal data. It does not automatically require the underlying data to be hosted in the Isle of Man; legal and contractual requirements still apply.

Accreditation and registration do not guarantee data value, accounting recognition, finance or investment returns. Implementation is ongoing, with regulations, guidance and operational arrangements still being developed.
